This website is operated by Homeowner Program LLC on behalf of True Good Energy Builds Inc, the provider who will contact you regarding your request, including by phone and SMS.

Please read these Terms of Use carefully before using this website. By accessing or using the Site, you agree to be bound by these Terms in their entirety.

INTRODUCTION AND ACCEPTANCE OF TERMS

This website (the "Site") is owned and operated by Homeowner Program LLC ("Company," "we," "our," or "us"). These Terms of Use (the "Terms"), together with our Privacy Policy, govern your use of the Site and Services.

BY ACCESSING OR USING THE SITE, VIEWING ANY CONTENT, SUBMITTING ANY INFORMATION REQUEST FORMS, OR USING ANY SERVICES (COLLECTIVELY, THE "SERVICES"), YOU AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY.

IMPORTANT NOTICE: These Terms contain disclaimers of warranties, limitations of liability, a class-action waiver, and a mandatory arbitration provision that affect your legal rights. Please review them carefully. If you do not agree, you may not use the Site or Services.

ELIGIBILITY

The Services are available only to individuals who (a) are at least 18 years of age or the age of majority in their jurisdiction, (b) are legally capable of entering into binding contracts, and (c) are not prohibited from using the Services under applicable law.

DESCRIPTION OF SERVICES

Homeowner Program LLC provides advertising and a matching service that connects each homeowner with a single independent home-improvement service provider based on their request. We do not provide home-improvement services directly, and we do not distribute your request to multiple companies. The provider matched to your request — True Good Energy Builds — is solely responsible for the services they provide and for communicating with you about your inquiry.

Homeowner Program LLC does not itself call or text you regarding your project; communications are sent by the matched provider, True Good Energy Builds. We do not endorse, guarantee, or assume responsibility for the matched provider's work, and you are responsible for independently evaluating their licenses, insurance, credentials, and suitability before engaging them.

USER INFORMATION AND CONSENT

4.1 Information Collection

When you use the Services, you may be asked to provide your name, email address, telephone number, physical address, homeownership status, property information, and other information requested via applicable forms ("User Information").

4.2 Accuracy of Information

You agree to provide true, accurate, current, and complete User Information. Providing false or misleading information may result in termination of your access to the Services.

4.3 Communication Consent

By submitting your User Information and using the Services, you consent to be contacted by the matched provider, True Good Energy Builds, regarding your request via telephone, email, and SMS/text message.

If you provide "prior express written consent" as defined by the TCPA (47 U.S.C. § 227), you may be contacted via autodialed calls, artificial or pre-recorded voice messages, and SMS text messages at the number you provide. Your consent is not required as a condition of purchasing any goods or services, and you may revoke consent at any time by following the opt-out procedures described below.

Our collection, use, and disclosure of User Information is governed by our Privacy Policy, incorporated by reference.

SMS / TEXT MESSAGING

By submitting your information and mobile number, you consent to receive calls and text messages from True Good Energy Builds, the provider matched to your request, regarding your inquiry. Message frequency varies. Standard message and data rates may apply.

You may opt out at any time by replying STOP, and reply HELP for help. You may also contact True Good Energy Builds at [email protected] or (415) 800-9907.

We do not sell, rent, or share mobile phone numbers or SMS opt-in consent with third parties or affiliates for their own marketing purposes.

The Services are not endorsed, administered, or sponsored by any wireless carrier. Carriers are not liable for delayed or undelivered messages.

USER CONDUCT AND RESTRICTIONS

You agree not to: violate any applicable law; infringe the rights of others; transmit unlawful, harmful, or objectionable material; impersonate any person or entity; transmit viruses or malicious code; interfere with or disrupt the Site; attempt unauthorized access to any systems; use automated means without our written permission; harvest personal information; or use the Site for any unauthorized commercial purpose. We may remove content, suspend or terminate access, and pursue legal remedies against violators.

INTELLECTUAL PROPERTY RIGHTS

All content on the Site, including text, graphics, logos, images, and software (the "Content"), is the property of Homeowner Program LLC or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from any part of the Site or Content without our written permission.

USER SUBMISSIONS

If you submit ideas, suggestions, or feedback ("Submissions"), you grant us a perpetual, worldwide, royalty-free, irrevocable, transferable license to use, reproduce, modify, publish, and distribute such Submissions for any purpose without compensation or attribution.

DISCLAIMERS OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT YOU WILL SUCCESSFULLY CONNECT WITH A PROVIDER OR THAT THE QUALITY OF ANY SERVICES WILL MEET YOUR EXPECTATIONS.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HOMEOWNER PROGRAM LLC OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, OR FROM ANY INTERACTIONS WITH THE MATCHED PROVIDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF FIVE HUNDRED DOLLARS ($500.00) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. NO ACTION MAY BE BROUGHT MORE THAN ONE (1) YEAR AFTER THE EVENT GIVING RISE TO THE CLAIM.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Homeowner Program LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or relating to your use or misuse of the Site or Services, your violation of these Terms or any rights of a third party, your User Information, or your interactions with the matched provider. This obligation survives termination of these Terms.

DISPUTE RESOLUTION AND ARBITRATION

13.1 Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles.

13.2 Informal Resolution

Before filing any claim, you agree to first contact us to attempt to resolve the dispute informally by writing to Homeowner Program LLC, Attn: Legal Department, or [email protected]. The parties agree to negotiate in good faith for at least thirty (30) days.

13.3 Binding Arbitration

If the dispute is not resolved informally, you agree that any claim arising out of or relating to these Terms or the Site shall be resolved exclusively by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court, except that (a) you may assert qualifying claims in small claims court, and (b) either party may seek equitable relief for intellectual property infringement.

13.4 Class Action Waiver

YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13.5 Opt-Out of Arbitration

You may opt out of these arbitration provisions by sending written notice within thirty (30) days of first using the Site to Homeowner Program LLC, Attn: Arbitration Opt-Out, including your name, mailing address, email address, and a clear statement that you wish to opt out.

13.6 Severability

If any portion of this arbitration provision is unenforceable, the remainder shall be enforced, except that if the class action waiver is found unenforceable, the entire arbitration provision (but not the rest of these Terms) shall be null and void.

MODIFICATIONS TO TERMS

We may modify these Terms at any time by posting the updated Terms on the Site with a new Effective Date. Your continued use of the Site after changes become effective constitutes acceptance of the modified Terms.

TERMINATION

We may terminate or suspend your access to the Site or Services at any time, without notice or liability, for any reason, including if you breach these Terms. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and dispute resolution) shall survive.

COPYRIGHT INFRINGEMENT (DMCA)

We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act. Send DMCA notices to Homeowner Program LLC, DMCA Agent, [email protected].

STATE-SPECIFIC CONSUMER RIGHTS

Residents of certain states may have additional rights under state consumer protection and privacy laws. Please refer to our Privacy Policy for details.

GENERAL PROVISIONS

These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Company regarding the Site and supersede all prior communications. Our failure to enforce any provision is not a waiver. If any provision is held invalid, the remaining provisions remain in effect. We may assign these Terms without restriction; you may not assign them without our written consent. Nothing in these Terms creates any agency, partnership, or joint venture between you and the Company.
